Under the Immigration Act 2009, persons unlawful in New Zealand have no statutory right to submit an application for a visa. However, this does not mean that you cannot choose to submit a request for a temporary visa under section 61 of the Immigration Act 2009. Immigration New Zealand does not have to accept your request but if your case is exceptional Immigration New Zealand has the discretion to assess your request and ultimately issue a visa to you based on your grounds for the request.

If you are unlawful in New Zealand you should depart lawfully to be able to re-enter New Zealand in the future.
